Terms of Use
Welcome to Idea In Hand. These terms are an agreement between you and Idea In Hand (“we”, “us”) about using this website, the design editor, the design assistant and ordering custom products. By creating an account, using the site or placing an order, you agree to these terms, our Privacy Policy and our Refund & Returns Policy.
Your account
- Your account is for you only. Keep your password safe; anything done with your account is treated as done by you. Tell us straight away if you think someone else is using it.
- If you are under 18, please use the site and place orders with the consent of a parent or guardian.
- We may suspend or close an account that breaks these terms, or to prevent fraud and abuse.
The design assistant and credits
- The design assistant and image generation are powered by AI. Results can be wrong, differ from what you meant, or resemble existing works. Please check every word, spelling, date, colour and image before you order.
- Using AI features uses credits. Credits are an allowance for this site’s AI features, not money: they can’t be cashed out, transferred or refunded. The cost of each step is shown on the site and may change.
- AI features may be unavailable at times because of maintenance, third-party services or usage limits; we don’t guarantee they are always available.
Your content
- You (or the original rights holder) keep ownership of the images, photos and text you upload and the designs you make.
- To provide the service, you let us store, copy and process your content: to send it to the AI providers behind the design assistant, and to the partners who make and deliver your products.
- If you publish a design to the Workshop or create a share link, you agree that others can see it; other users can start their own design from a design published to the Workshop. You can remove it at any time.
- You promise that you have the right to use what you upload and order: people in your photos agree to it, you are allowed to use any trade marks or logos, and it doesn’t infringe anyone’s copyright, image or privacy.
Content we don’t accept
- Content that infringes someone else’s intellectual property, such as unlicensed brands, cartoon characters or team logos;
- Illegal, hateful, harassing, threatening or discriminatory content;
- Sexual content, and any inappropriate content involving minors;
- Content that impersonates others, imitates official documents or is meant to deceive.
We may refuse to make such orders (with a full refund of anything paid), remove the content, suspend the account and, where required by law, cooperate with authorities.
Prices and orders
- Prices are in Australian dollars (A$) and include GST unless stated otherwise. Shipping and discounts are shown at checkout.
- Placing an order is an offer to buy; the contract is formed when we confirm your payment. If we can’t make it (for example the content isn’t accepted, materials are out of stock or a price is obviously wrong), we’ll let you know and refund you in full.
- The design, size, colour option and quantity you confirm in the editor and at checkout are what we produce.
Production and how it looks
- Products are made to the design you confirm. Normal differences in colour and texture between screen and product are expected; 3D previews and mockups are illustrations, not photos.
- You are responsible for checking the text, spelling, dates and layout in your design. A remake needed because of a mistake in content you approved isn’t a quality fault.
- Production and delivery times are estimates and may change because of production, couriers or holidays; we’ll tell you as soon as we can about any significant delay.
Cancellations, refunds and the Australian Consumer Law
Cancellations and refunds are handled under our Refund & Returns Policy.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those rights.
Liability
To the extent permitted by law, we are not liable for indirect loss arising from use of the site or products (such as lost profits or changes to event plans). Where a guarantee can’t be excluded, our liability is limited to supplying the goods or services again, or paying the cost of having them supplied again.
Changes
We may update the site and these terms. We’ll highlight important changes on the site; continuing to use the site after a change means you accept it. Orders placed before a change follow the terms in place when you ordered.
Governing law
These terms are governed by the laws of Australia.
